Website Service Terms

Please fill in the date and company number before relying on these terms. Have a solicitor review once before use — particularly the liability, IP, and data-protection clauses.

1. Who these terms are between

These terms are an agreement between Flewidity Ltd (company no. 16615633, registered in England & Wales) (“we”/“us”/“Flewidity”) and you (“the Client”). They apply from the date you start your subscription.

2. The service

We will design, build, host, and maintain a website for your practice. Your subscription includes:

  • Hosting and the technical upkeep needed to keep the site online and secure.
  • One minor change per month on request — for example text edits, swapping a photo, updating your fees or contact details. Unused changes do not roll over.

The following are not included and can be quoted separately: new pages or sections, a redesign, added functionality (e.g. online booking, e-commerce), logo or brand design, copywriting beyond minor edits, and SEO or marketing campaigns.

3. Fees and payment

  • Monthly fee: £30 per month, inclusive of VAT, billed in advance via Stripe.
  • Setup fee: none.
  • If a payment fails, we'll attempt to take it again. If it remains unpaid after 14 days, we may suspend the site until payment is brought up to date.

4. Term and cancellation

  • The subscription runs month to month with no minimum term — you can cancel at any time, effective at the end of your current paid month. There is no lock-in.
  • On cancellation, hosting ends and the website is taken offline. Your own content (your words, your logo, photos you provided) remains yours and we'll return a copy on request.
  • The website design and code remain our intellectual property (see clause 5) and are not transferred on cancellation unless separately agreed in writing.
  • If we moved your domain name to point at our hosting, your domain remains yours at all times. On cancellation we'll release it or point it back as you direct — we will never withhold your domain.

5. Intellectual property

  • Content and brand you provide (text, logo, photos) stay yours. You confirm you have the right to use anything you give us.
  • The website we build — its design, layout, and code — is licensed to you for the duration of your subscription and remains Flewidity's intellectual property. The licence ends when the subscription ends.

6. Your responsibilities

  • Provide accurate information, and ensure any professional qualifications, registrations, or memberships shown on the site (e.g. BACP, UKCP, NCPS) are current and correct — these are your responsibility.
  • Ensure materials you supply don't infringe anyone else's rights.

7. Data protection

Where your website collects enquiries (e.g. via a contact form), you are the data controller for that information and we process it on your behalf to deliver the site and pass enquiries to you. Both of us will comply with UK data protection law (UK GDPR and the Data Protection Act 2018). We won't use your enquirers' data for any purpose other than running your site.

8. Availability and support

We'll use reasonable care and skill to keep your site online and working, but we do not guarantee uninterrupted availability, as parts of the service rely on third parties (e.g. hosting providers and your domain registrar). We'll address issues you report promptly.

9. Liability

  • Nothing in these terms limits liability that cannot legally be limited (such as for death or personal injury caused by negligence, or fraud).
  • Subject to that, our total liability to you in any 12-month period is limited to the total fees you paid us in that period.
  • We are not liable for indirect or consequential losses, or for loss of profit, business, or data.
  • Flewidity holds professional indemnity insurance.

10. Changes to the service or fees

We may adjust the monthly fee or these terms by giving you at least 30 days' notice. If you do not accept a change, you may cancel before it takes effect.

11. Confidentiality

Each of us will keep the other's non-public information confidential and use it only to perform this agreement.

12. Governing law

These terms are governed by the law of England & Wales, and the courts of England & Wales have exclusive jurisdiction.
